These Terms and Conditions (“Terms”) govern the use of the Swipe platform by craftsmen and service providers on the one hand and by clients on the other hand. Swipe is a digital intermediary platform through which clients can publish service requests and providers can submit matching offers.
Where these Terms refer to “Swipe”, “we”, “us” or “our”, this means the platform operator identified in the imprint or legal notice of the active Swipe domain, unless a different invoicing entity or payment provider is expressly identified in a specific payment or billing flow.
Swipe is not itself a party to the service contracts concluded between clients and providers unless expressly stated otherwise in a specific case. As a rule, Swipe therefore does not owe the service promised by the provider and does not owe the remuneration owed by the client under the underlying service contract.
Depending on the active market, domain or country context, features, verification requirements, currencies, taxes, fees, payment and billing processes, contact details or available content may differ. The information shown in the relevant market and in the relevant usage context shall prevail.
A. Terms for Craftsmen and Service Providers
1. Scope and platform use
These provisions apply to users who use Swipe in the course of their commercial or self-employed professional activity in order to offer services, receive request opportunities or initiate and handle jobs through the platform.
By registering, you enter into a user agreement with Swipe for the use of the provider functions of the platform. The user agreement is personal or business-related and may not be transferred to third parties without our consent.
Swipe may make access to specific functions, markets or product areas subject to the successful completion of registration, verification, approval or billing processes.
2. Registration, provider details and verification
You must provide accurate, complete and up-to-date information during registration and throughout the term of use, including your identity, your business, your contact details, your address, your services, your market affiliation and, where necessary, your tax or billing data.
Swipe may request proof relating to identity, business registration, professional authorization, company status, tax data, payout data or other regulatory information. This may include identity checks, document uploads, manual admin review as well as requests for additional documents or resubmissions.
Swipe may restrict provider accounts in whole or in part, decline activation, request revisions or reject accounts in the event of material inconsistencies until such checks have been completed successfully.
Multiple accounts, sham profiles, misleading information or the use of third-party or inaccurate company data are prohibited.
3. Credentials and account security
You must keep your login credentials confidential and protect them against unauthorized use. Passing them on to unauthorized third parties is prohibited.
If you have indications that your account or credentials have been compromised, you must inform Swipe without undue delay. Swipe may temporarily suspend access or take protective measures where security concerns exist.
4. Market restrictions, visibility and availability
Swipe may sort, filter or limit offers, requests, profiles and other content depending on the active market, the domain used, the category, the service area, the language, relevance, verification, profile completeness and other objective quality or safety criteria.
Where Swipe ranks or highlights content, this is generally based on objective platform criteria. Paid preferential placement is not currently offered unless expressly labeled as such.
Swipe does not owe any particular number of requests, reach, placement or economic success.
Swipe aims to provide the platform with as little interruption as possible. However, temporary restrictions, maintenance windows, technical failures, security measures or market-specific limitations may occur.
5. Provider profile, profile picture, portfolio and content
You may present your business on Swipe using the functions provided by the platform, including company information, service descriptions, categories, service areas, a profile picture, portfolio files, reference images and other content.
If you upload content for your public provider profile, in particular a profile picture or portfolio files, such content may be displayed in the public provider profile or in other intended views of the platform and may be technically accessible to the public.
You retain ownership of your content. However, you grant Swipe a non-exclusive, worldwide right, limited to the duration of use, to store, reproduce, technically process, transmit, display on the platform and, where required by the platform function, make such content publicly available.
You may only upload content for which you hold the necessary rights and whose use does not infringe third-party rights, applicable law or regulatory requirements.
6. Offers, pricing and contract conclusion with clients
Requests published by clients are generally invitations for providers to submit offers. By submitting an offer, you declare your willingness to perform the described job on the terms stated by you.
You must state your offered price fully and accurately. Where legally required, taxes, surcharges, ancillary costs, prerequisites or limitations must be transparent in the offer or its explanation.
Swipe may impose market-specific minimum or maximum amounts as well as technical or regulatory price limits and may reject offers outside those limits.
The service contract is concluded exclusively between you and the client when the client accepts your offer through the platform or the parties otherwise expressly confirm the engagement through Swipe. Swipe is not itself a party to that service contract.
Until accepted by the client, offers may only be withdrawn, deleted or replaced within the functions provided on the platform. If a client accepts an offer, other open offers for the same request may automatically be marked as rejected or completed.
You are solely responsible for ensuring that the services you offer and perform are lawful and that you possess all required permits, insurance, registrations, authorizations and qualifications.
7. Platform fees, payments, invoices and refunds
Swipe may charge market- and product-specific platform fees, success fees, commissions or other usage-based charges to providers. Whether, when and in what amount such a charge arises depends on the product logic, pricing, payment flow or billing overview shown in the active market.
Where a success fee or platform fee applies, it may in particular be triggered when a client accepts an offer or upon another clearly designated charge event on the platform.
The currency, taxes, fee rates, pricing tiers and billing parameters shown in the active market shall prevail. Information shown in one market or on one domain does not automatically apply to other markets or domains.
Swipe may use external payment providers. To the extent required for payment processing, payouts, invoicing, credit notes, tax documentation or compliance checks, you must provide complete and accurate billing and payout details. Without such data, Swipe may refuse or delay payments, invoices, credit notes, activations or payouts.
Invoices, credit notes and comparable documents may be provided or transmitted electronically. You are required to review such documents in a timely manner and raise any objections without undue delay.
You may not circumvent platform fees by using Swipe to initiate a business relationship and then intentionally completing the engagement outside the intended Swipe functions or encouraging clients to do so.
Refunds, partial refunds, cancellations or corrections depend on the specific case, the active market, the payment services used, any published refund rules and mandatory legal requirements. Refunds are not limited exclusively to account credit unless expressly stated in the specific case.
In the event of payment default, Swipe may restrict access to payment-related or additional functions until open claims are clarified or settled, to the extent proportionate.
8. Communication, contact release and lawful use
Swipe may link messaging functions, chat functions, contact sharing and similar interactions to certain workflow stages, such as offer acceptance, payment status or project status. There is no entitlement to earlier release.
You may use personal data or contact details of clients solely for communication and execution of the specific project and for any legally permitted follow-up. Use for unsolicited advertising, address trading or other unrelated purposes is prohibited.
Using Swipe to initiate or carry out unlawful activities, in particular undeclared work, sham services, fraudulent offers, improper circumvention arrangements or other legal violations, is prohibited.
9. Communication standards, moderation and sanctions
Only lawful, factual and respectful content may be published or communicated on Swipe. Prohibited content includes, in particular, insulting, discriminatory, misleading, false, rights-infringing, threatening, pornographic, violent, spam-like or technically harmful content as well as prohibited scripts, links or circumvention attempts.
Swipe may review, remove or hide content, process reports, temporarily restrict access or functions and suspend or terminate accounts in whole or in part where this is necessary to enforce these Terms, for security reasons, to protect other users or to comply with legal obligations.
Where legally or factually possible, Swipe will inform affected users of significant moderation or suspension measures. In urgent cases or where required by law, a measure may also be taken without prior notice.
If you have questions about measures taken against your account or content, you may contact the support channel specified on the platform.
10. Reviews
After project completion or completion confirmation, Swipe may provide review, rating or feedback functions. Reviews must be factual, truthful and related to the project in question.
Swipe may moderate, hide or remove reviews where there are concrete indications of breaches of these Terms, third-party rights or applicable law.
11. Data protection
The processing of personal data is additionally governed by Swipe’s current Privacy Policy.
12. Liability
Swipe has unlimited liability for intent and gross negligence, for injury to life, body or health and in all cases of mandatory statutory liability.
In the event of a slightly negligent breach of essential contractual obligations, Swipe’s liability is limited to the foreseeable damage typical for this type of agreement. Essential contractual obligations are obligations whose fulfillment is necessary for the proper performance of the user agreement and on whose compliance you may regularly rely.
Otherwise, Swipe’s liability is excluded to the extent permitted by law.
In particular, Swipe is not liable for the legality, accuracy, completeness or quality of user information, offers, references, reviews or project outcomes, nor for the solvency, performance or contractual reliability of clients or providers. Any identity or document check does not constitute a guarantee regarding the quality or legality of a service.
13. Term, termination and amendments
The user agreement runs for an indefinite period. You may terminate your user agreement at any time with effect for the future, provided that no open legal, tax or billing obligations prevent this.
Swipe may terminate, suspend or restrict the user agreement or individual functions in whole or in part for good cause, in particular in the event of breaches of these Terms, security risks, legal violations, failure to cooperate in verification procedures or unresolved payment disputes.
Any payment claims, billing claims, documentation duties, retention duties and continuing effects of these Terms that have already arisen shall remain unaffected by termination.
Swipe may amend these Terms with effect for the future where there is an objective reason to do so, in particular in the event of changes in law, markets, security requirements, functions or billing models. We will inform you of material changes in an appropriate manner before they take effect.
14. Final provisions for providers
These Terms and the user agreement between Swipe and providers are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory legal provisions provide otherwise.
If the provider is a merchant, a public-law entity or a special fund under public law, Frankfurt am Main shall be the exclusive place of jurisdiction for all disputes arising out of or in connection with the user agreement, to the extent permitted by law.
B. Terms for Clients
1. Scope and registration
These provisions apply to users who use Swipe as clients to publish service requests, receive offers from providers and select providers for projects.
Certain functions require a user account. During registration and when using the platform, you must provide accurate, complete and up-to-date information about your identity, your contact details and, where necessary for the relevant process, your address or project address.
Multiple accounts, misleading identities or the use of third-party data are prohibited.
Swipe may restrict or vary functions and content depending on the active market, domain or project context.
2. Credentials and account security
You must keep your login credentials confidential and protect them against unauthorized use. If you have indications that your account is being misused, you must inform Swipe without undue delay.
3. Your requests and content
You may publish requests, descriptions, images, documents and other project-related content on Swipe where the platform provides such functionality. Your information must be accurate, lawful and necessary for the requested job.
You may only upload or publish content for which you hold the necessary rights. You retain ownership of your content. However, you grant Swipe the rights required to store, technically process, transmit, display to matching providers, moderate and otherwise process such content for the operation of the platform.
Your request content may in particular be shown to matching providers, support and moderation teams and, where technically provided, to other authorized recipients within the platform. Please do not publish sensitive or unnecessary personal data unless required for the request.
4. Offers, selecting a provider and service contract
Requests published on Swipe are generally invitations for providers to submit offers. Offers submitted by providers do not constitute a promise or guarantee by Swipe.
If you accept a provider’s offer through Swipe or the parties otherwise expressly confirm the engagement through Swipe, the service contract is concluded exclusively between you and the selected provider.
Swipe is not itself a party to the service contract and therefore does not owe performance of the service nor payment or enforcement of the remuneration under that contract.
Once an offer is accepted, other open offers may be technically closed, marked as rejected or removed from the active selection process.
Unless expressly stated otherwise, the use of the platform as a client is free of charge. Any payments for the actual service are agreed directly with the selected provider.
5. Communication and platform availability
Swipe aims to provide the platform as reliably as possible. However, temporary limitations, maintenance, security measures, third-party outages or market-specific restrictions may occur.
Swipe may connect communication channels, chat functions or contact sharing to specific process stages. There is no entitlement to a specific communication channel or immediate visibility of contact details.
6. Communication standards, prohibited content and sanctions
You may only use Swipe lawfully and respectfully. Prohibited conduct includes, in particular, insulting, discriminatory, misleading, false, rights-infringing, threatening, spam-like or technically harmful content as well as using the platform for unlawful or abusive purposes.
Swipe may moderate, remove or hide content, process reports, restrict functions or temporarily or permanently suspend user accounts where this is necessary to enforce these Terms, for security reasons, to protect other users or to comply with legal obligations.
Where legally or factually possible, Swipe will inform affected users about significant measures. In urgent cases or where required by law, a measure may also be taken without prior notice.

10. Term, termination and amendments
The user agreement runs for an indefinite period. You may terminate your user account and the user agreement at any time with effect for the future, provided that no open legal or billing-related reasons prevent this.
Swipe may terminate, suspend or restrict the user agreement or individual functions in whole or in part for good cause, in particular in the event of breaches of these Terms, security risks or legal violations.
Swipe may amend these Terms with effect for the future where there is an objective reason to do so. We will inform you of material changes in an appropriate manner before they take effect.
11. Final provisions for clients
These Terms and the user agreement between Swipe and clients are governed by German law, unless mandatory consumer protection provisions of the country in which the client has their habitual residence provide otherwise.
If the client is a merchant, a public-law entity or a special fund under public law, Frankfurt am Main shall be the exclusive place of jurisdiction for all disputes arising out of or in connection with the user agreement, to the extent permitted by law.
C. Severability
If individual provisions of these Terms are or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall replace the invalid provision. The same applies in the event of any gap in these Terms.
